1. Our Data Minimization Approach

EZ-CAPSS provides a software subscription solution for second-hand dealers and related businesses. The application helps customers capture and manage customer and item information.

The application is designed so that customer and item information entered into the application (“Customer Data”) is stored locally on the Customer’s device or Customer-controlled environment.

At this time, EZ-CAPSS does not retain, copy, host, or store Customer Data on EZ-CAPSS servers.

2. Information We Do Not Collect

EZ-CAPSS does not collect, access, retain, copy, or store Customer Data entered into the application, including customer records or item records maintained locally by the Customer.

Customers are responsible for securing, backing up, retaining, deleting, and managing Customer Data stored locally on their own devices or systems.

3. Information We May Collect

3.1 Account and Contact Information

When you register, purchase, request support, or communicate with us, we may collect information such as:

• Name;
• Email address;
• Phone number;
• Mailing or billing address;
• Company or business name;
• Account credentials and account status;
• Subscription, invoice, purchase order, and support information; and
• Other information you choose to provide.

3.2 Payment Information

Payments may be processed by third-party payment providers, including Stripe and PayPal. Depending on your payment method, these providers may collect and process payment card information, PayPal account information, billing details, transaction identifiers, fraud prevention data, and related payment information.

EZ-CAPSS does not store full credit card numbers or complete financial account credentials on its servers.

3.3 Usage Statistics and Analytics

EZ-CAPSS may collect limited statistics and usage information for internal business, marketing, product improvement, performance monitoring, support, and operational analysis.

This information may include feature usage, device or browser type, operating system, general technical information, error or performance data, approximate usage patterns, pages visited, and subscription or account activity.

Usage statistics are used internally by EZ-CAPSS and are not shared with outside entities for their independent marketing purposes. Analytics do not include Customer Data stored locally in the application.

3.4 Website and Device Information

When you visit our Site, we may collect technical information such as IP address, browser type, device type, operating system, referring pages, pages viewed, dates and times of access, and similar information.

3.5 Communications

If you contact us, request support, request sales information, or report a problem, we may collect the content of your communications and related contact information.

4. How We Use Information

EZ-CAPSS may use information for the following purposes:

• To provide, operate, maintain, and improve the Services;
• To create and manage accounts;
• To process subscriptions, payments, invoices, purchase orders, renewals, and refunds where applicable;
• To provide customer support and respond to inquiries;
• To perform internal analytics, marketing analysis, and product improvement;
• To communicate about updates, billing, support, security, and administrative matters;
• To detect, prevent, and respond to fraud, misuse, security risks, payment disputes, or unlawful activity;

5. How We Share Information

EZ-CAPSS does not sell Customer Data or personal information.

We may share limited information only as necessary for legitimate business, operational, legal, or compliance purposes, including with:

• Payment processors, such as Stripe and PayPal, to process payments, subscriptions, renewals, disputes, fraud prevention, and billing;
• Service providers that support website hosting, support, communications, analytics, security, or business operations;
• Legal, regulatory, or government authorities when required by law, subpoena, court order, or legal process;
• Professional advisors, such as attorneys, accountants, auditors, and insurers;
• Successors or assigns in connection with a merger, acquisition, financing, reorganization, sale of assets, or similar transaction; and
• Other parties with your consent or at your direction.

Third-party service providers are permitted to use information only as necessary to provide services to us or as otherwise permitted by law and their applicable terms.

6. Stripe and PayPal

If you pay through Stripe or PayPal, your payment information is processed by the applicable provider. Their collection and use of information is governed by their own terms and privacy policies.

EZ-CAPSS may receive limited transaction information from Stripe or PayPal, such as transaction status, payment confirmation, customer identifier, subscription status, billing address, amount paid, payment failure notices, refund information, and dispute or chargeback information.

EZ-CAPSS may use payment and transaction information to manage subscriptions, resolve billing issues, respond to disputes, prevent fraud, and comply with legal or accounting obligations.

7. Cookies and Similar Technologies

Our Site may use cookies, pixels, tags, log files, or similar technologies for functionality, analytics, performance, security, and user experience.

You may be able to control cookies through your browser settings. Disabling cookies may affect Site functionality.

8. Data Security

EZ-CAPSS uses commercially reasonable administrative, technical, and organizational safeguards designed to protect account-related information, billing-related information, and our systems.

Security measures may include access controls, authentication, encryption in transit where applicable, monitoring, logging, patching, and internal security practices.

No method of transmission, storage, software, network, device, or electronic system is completely secure. EZ-CAPSS cannot guarantee absolute security.

Because Customer Data is stored locally and controlled by the Customer, Customers are responsible for securing their own devices, networks, backups, credentials, and local data.

9. SOC 2 and Security Standards

EZ-CAPSS has not obtained SOC 2 certification at this time. EZ-CAPSS aims to align its security practices with generally accepted industry standards appropriate to the nature and scope of the Services.

10. Data Retention

EZ-CAPSS retains account, billing, support, analytics, legal, and business records for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Services, maintain business records, comply with legal obligations, resolve disputes, prevent fraud, and enforce agreements.

EZ-CAPSS does not retain Customer Data stored locally in the application because such data is not stored on EZ-CAPSS servers.

11. Customer Responsibilities for Local Data

Because Customer Data is stored locally, you are responsible for:

• Determining what information to enter into the application;
• Providing legally required notices to your own customers where applicable;
• Obtaining any required consents;
• Securing devices and systems;
• Maintaining backups;
• Responding to requests from your own customers; and
• Complying with laws applicable to your business and Customer Data.

12. Your Privacy Rights

Depending on your location, you may have rights regarding personal information that EZ-CAPSS controls, such as the right to request access, correction, deletion, portability, or restriction of certain information.

Because EZ-CAPSS does not store Customer Data entered into the application, requests relating to Customer Data stored locally must be handled by the Customer that controls that data.

13. California Privacy Notice

If you are a California resident, you may have rights under California privacy laws, including the right to know, access, correct, delete, or limit certain uses of personal information, and the right not to be discriminated against for exercising privacy rights.

EZ-CAPSS does not sell personal information. EZ-CAPSS does not knowingly share personal information for cross-context behavioral advertising as those terms may be defined under applicable California law, unless otherwise disclosed at the point of collection.

14. Children’s Privacy

The Services are intended for business users and are not directed to children under 13. EZ-CAPSS does not knowingly collect personal information from children under 13. If we learn that we have collected such information, we will take appropriate steps to delete it.

15. International Users

EZ-CAPSS is located in the United States. If you access the Services from outside the United States, you understand that information may be processed in the United States or other jurisdictions where privacy laws may differ from those in your location.

16. Legal Compliance and Protection

EZ-CAPSS may access, preserve, use, or disclose information if we believe it is reasonably necessary to comply with legal process, enforce agreements, protect the rights, property, or safety of EZ-CAPSS, users, customers, or the public, prevent fraud or abuse, or respond to lawful requests.

Our Site or Services may contain links to third-party websites or services. EZ-CAPSS is not responsible for the privacy practices, content, policies, or services of third parties. Your use of third-party services is subject to their terms and privacy policies.

EZ-CAPSS may update this Privacy Policy from time to time. Updated versions may be posted on the Site or otherwise provided to you. Continued use of the Services after an updated Privacy Policy becomes effective indicates acceptance of the updated policy.
